Who can live in house during divorce?

I'm getting divorced, and the house has already been refinanced under my name, my husband signed the quit claim deed to remove himself and all claims to the house. But he is still living there. Can I kick him out before the divorce is final? Is there any legal time frame where he can legally still reside there? Our son is still in the house, but could easily live with me, until my husband moves out. Do I have any rights to kick him out?

Since he has already signed the quick claim papers, he needs to get out ASAP.

Regardless of if he signed a new deed removing his name from the property or not, the property is still a marital asset and he is just as entitled to it as you are. He owns 50% of the home and you own 50% of the home so noone can be kicking the other out until the divorce is final and the judge has split the assets fairly.

Both parties can stay until everything is final. The last person I know to get a divorce - a guy - had been advised by his lawyer to do that. I would think if you want him out, you'll have to start the eviction process...

Good question! I would think that because he signed a quit claim, he has no rights concerning the house anymore, however, I'm not a lawyer.

In PA i believe that the law allows both parties to reside until the divorce is finalized.

Both parties are allowed to live in share residents while going thru a divorce until a final ruling is given by the judge.

Since its in your name I don't see why you wouldn't have grounds to put him out. But I don't know I'm no lawyer and it varies state to state. Maybe you should call a lawyer!

its your house which means you get to say who does and doesnt get to stay there. you can have him forcibly removed.
