What options do i have? my exhusband is 5 months behind in mortgage of the house we owned together?

He was given 6 months to refinance and take my name off so my credit isn't harmed. Neither one of us live in the house. I've spoken to him a few months ago and he said he was taking care of things, but obviously he isn't. What can be done so my credit isn't ruined because of this?

You need to be asking a lawyer, not YA. Why haven't you stayed on top of this every week - until it was settled?

Contact your attorney as soon as possible and tell him. He might be in contempt of court, but you will not know until you talk to your lawyer.

Call your lawyer, you may have to have this matter settled in court if he was to pay the mortgage payments on the house..and take your name off the mortgage..if there is a current court order for him to do so..

(A) You can try to work a deal with the bank that forcloses on him and gives you the house and you assume the payments.(B) Pay the payment -- from the banks perspective you signed and are responsible regardless of what the other party does and yes that eprson is still on the mortgage. That's what I did raising two kids with one less income and a brand new day care bill, the ex didn't pay a dime and then she ended up with 100% of the equity when it sold. But I made out great, I got rid of her.(C) your credit gets ruined as it should but you don't go to debtors prison.

You send a copy of the court order to all three major credit bureaus and ask them to be certain to remove any reference of the problem from your history.

Before I left the house I called the bank and set up the new morgage, I watched him sign it. I get, no matter what, what the house was worth 5 years ago. Wich is alot more then it is worth now.He pays that morgage, cause if he don't he'll have nothing to sell to pay me. It was court orderd to sell the house immediatly, but there was and is no buyers out there. Sounds like you better call a lawyer to make sure you get your half the assets anyways. If worse comes to worse you will have extra income when you ask for credit becouse he will have to pay
