What is required to remove someones name from a deed on a house?
EdwinIf we helped our son purchase his first home and all three names are on the deed. What would be required if sometime down the road we wanted to be removed from deed. Do we need to refinance? Not saying we don't want to be responsible for loan just wondering about the deed.
AshlieShould be simple. Just get a quit claim deed giving your portions of the house to him. An attorney can draw this up for $100 or so, and should be fairly quick about it. Then, you record it at your county's recorder's office.
JennellProperty title and mortgage loan are two different things. You can quit claim your interest in the title to your son, but if you are on the mortgage loan, it must be paid off - either via cash or via a refi in his name alone. Do nothing without the advice of a lawyer - there could be legal or tax consequences.
Elidiaif you are on the NOTE then you must remain on the deed as any change in the deed of trust will trigger the due on sale clause so the only other way in a few years is to refinance the loan in his name only I am a mortgage banker in TN & KY
VincentYou just need to re-register the title to the house in your sons name only. This does not however remove you from the mortgage if you are also co-signers to it. I believe you can file a quit claim fairly inexpensively.
