AyanaThe mortgage doesn't matter. It's what is on the deed. I'm not on the mortgage to my house but on the deed so I'm still part owner of the house.
GerriIt depends on the state you live in. In NC where I live, a spouse has marital interest in any property owned, and still has to sign the deed of trust, or the actual mortgage at closing. The only way to remove a spouse from the mortgage is for that spouse to do a quitclaim deed to the other, relinquishing all their interest in the house. I think you need to check with a real estate attorney in your area and be clear on the laws of your state. It may be too late as you have already closed and the mortgage is recorded, but check with an attorney anyway.PS-NEVER sign anything, ESPECIALLY a legal document, without knowing what you are signing.
DamianDepends on your state. I do know that in the state of Ohio, there is a law that helps protect the spouse. As long as your name is still on the deed, you are still co-owner of the house. Also, if you were to divorce, this would make him solely responsible for the mortgage payment, yet you are still entitled to half of the home. Check the deed and see if your name is still on it. If so, he may have did you a favor and hurt himself! Good Luck!

What you need to do is find an attorney in your area that will give you a free consult and take the previous mortgage papers and the refinance papers to him to see what your legal stand is.RedEdit. In Calif. my good friend's husband recently died and he had their house mortgaged in his name only. She had to refinance the house and pay all kinds of fees to get things in her name. Just a warning. If it were me, I would take hubby to the bank and change this situation right away. Just to protect your self.
RoseannaIn most states you are still on the deed as a party residing in the home...That gives you legal claim to the property in the event your husband and you separate.Your case will be stronger if you contribute to the household finances, for example have a paying job outside of the home.

MargareteIn the state of California it is common law property. Anything that is bought or made during the marriage belongs to both spouses. I think in most states it is, YES you do still own the house.

Barriecheck the title or deed.My wife and i refinenced i put her name on it for better credit rates. She is listed as the mortgagee, i am listed on the deed/title of the hosue still.
ElodiaIn Arkansas it doesn't matter whose name is on there. It's a shared property state. Half and half if there ever comes a divorce.

JulietNope.If your name has been removed from all the ppw then he only owns the house. If you are on good terms then why did he remove your name? You should have a talk with him to figure this out, or better, have a talk with a lawyer...
