My husband is divorcing me our house is with a va loan can i drop his name off the house without refinancing?

my credit is ruined because i pay all the bills and i had to let some be late and i don't know what to do i desprately need help he cant afford this home the reason we got it was because of his va and my income. please please help me!!!

Sounds like the loan is in both of your names. You cannot ask the mortgage company to just remove his signature from the promise to pay note. It does not work that way. The only way to have the mortgage note in your name is to get your own mortgage by refinancing. Now, I understand that your credit is ruined, so the refinancing may not be an option for you at this time.Through the divorce, your husband could very well force the sale of the home. You could either buy him out (which sounds like it is not an option) or sell it, and split the profits, if any.Ideally, this would work best for you: If he wants nothing to do with the house, have him quit claim the property deed to you, so you are the only one on the town record as owning the home. Continue to pay the mortgage and work on your credit score. Then, when you are financially healthy, refinance the mortgage so the loan is only in your name.I do believe these are your only options. you do not own the house, the bank does and they will not allow any mortgagees to take their name off the loan.

VA or not, the only way to drop his name off the loan IS to refinance. You're changing a huge part of the loan, and that is only way to modify home loans.If you can't at this moment, I would wait until the economy improves, then refi.

You won't be able to remove his name from the mortgage loan. You'll have to refinance the loan without his involvement to remove him from the mortgage. This won't remove him from the deed (ownership), he'll need to file a quit claim deed for that or sell you his stakes in the home. The best thing to do is work on repairing your credit. Get your bills current (even if you have to borrow money from friend or family) and keep everything perfect and on time. Pay the note on the mortgage as it stands, they don't care who pays the bill each month. Honestly, extending the divorce process as long as you can might be your best bet in terms of the house. Nothing will need to be done with the mortgage until the divorce is finalized and perhaps by then you can get your credit issues resolved or find someone willing to be a cosigner for you.

No if both your names are on the loan, and it is through the VA, So You will have to talk to your husband, about this, If he can't afford the loan why do you think you can, (unless the VA got you BOTH a good deal) If you want this house I think you will have to try to buy it, through your own loan, Just check and see!!!
