Just married and husband refinancing to put my name on mortgage?
AlisaI just got married and my husband is refinancing the house that he purchased many years before we were married to include my name on the mortgage. We live in the state of Maryland and I wanted to see if by putting my name on the mortgage, will I automatically be on the title of the house as well? Meaning, if we divorce years from now will the house be both of ours? I just want to make sure that if I am putting money into the house that if things dont work out I will be protected in someway with all of the money I put into paying the monthly mortgage.
RoxanaYou will not "automatically" be in title unless when you do the mortgage, he does a deed of gift from himself as sole owner into the two of you as tenants by the entirety with a joint right of survivorship to protect your rignts in a divorce and even more in the event one of you die.
KimbraOnly agree to the refinance, if before you sign off on the loan, he titles half interest to you in the home,
AdelleIf all you and your husband want to do is add your name to the deed then you are wasting money and going about it the wrong way.Your husband do not have to refinance the house to add your name to the deed. you and he need to contact a local title company, tell them what you want to do. They will set up an appointment for you to accomplish adding your name to the deed. They will charge a minimum fee for their service, but it is worth the cost to do it through a title company.Doing this transfer through a title company will prevent any possible legal problems in the future. You and your husband will have to determine how you will take title. This will protect you for any future negative actions taken such as divorce. The house would have to be divided between the two of you according to the laws of your state.I hope this has been of some use to you, good luck."FIGHT ON"
