Is it legal for my ex husband to borrow from the marital houses equity line?
IsaiasMy ex and I divorced nearly a year ago. Due to our current financial situation we left both of our names on the mortgage. I have been living in the house and making the mortgage payments since the separation. The intent was to sell or refinance but that hasn't been possible because of the housing crash. We have a line of credit that he recently withdrew $40k from without my knowledge. Is this legal? Both of our names are still on the line of credit. Do I have any legal recourse?
BuckNope... Since both your names were on the document, if he absconds without paying, YOU are on the hook for paying it..Divorce is divorce... you separate EVERYTHING. If the debt is still in joint name... then either or BOTH of you are responsible...Its legal.. and he CAN do it... sad to say...
ImaA BIG NO. Looks like you are being hoax if you did not see where the money went from the line of credit you are talking about. Isn't that already something to think about on your part? Maybe it's time now to go on your way 100%. He falsify something already, did he give you some money from his borrowing? well, I guess not. If he say you have to pay some of it, you'll have to - find a proof that you never saw the money and sue him. better talk to someone that has authority - or talk to him and tell him and let him sign something that he will solely pay for what he borrowed from that line of credit.
MelAssuming you had a lawyer for your divorce, you should contact the lawyer & ask this question.It's too bad that you didn't close that line of credit though. Then this could have been avoided.Good luck.
