KinaIf you hold title jointly, you have rights. If he refinances, you will have to execute papers acknowledging that the lender has a first security interest. As long as you are on the deed ( title) you are covered as an owner. If your husband dies, the bank could call in the mortgage- the entire balance becomes due. They would not have to offer you the same rate. I hope that helps. It is very common for one person to obtain the mortgage but two to own the home. It is especially common in one-income families.
