I filed chapter 7 bankruptcy 2 years ago and have kept my house?

The lawyer listed my house in the bankruptcy, even though I was keeping the house. I have continued to pay the mortgage for 2 years now. Now that the BK is 2 years old I am trying to refinance. The mortgage company has said that since the house was listed, it is just as bad as a foreclosure, and that I will need to reach out to Citibank (my mortgage company) to have this status removed. Is this possible, and what do I need to say to Citibank to make this happen?

You did not have a choice. It is required by law that you list ALL debts and ALL assets when you file bankruptcy.Did you reaffirm the mortgage? I think this may be the issue. If you did not sign a reaffirmation agreement at the time of the bankruptcy then many mortgage lenders stop reporting your payments to credit reporting agencies and you can have trouble refinancing.You can't "remove this status" if it reflects what is true.Have you checked your credit report? What has Citibank been reporting of your mortgage status? If Citibank has not been reporting your on time payments to credit reporting agencies since the bankruptcy was filed, you can try to prevail upon them to report those payments. You MIGHT be able to offer to reopen the bankruptcy case to file a reaffirmation agreement (if that is the problem). There is a $250 filing fee to reopen the bankruptcy case - talk to your bankruptcy attorney first and ask whether this would be possible and whether it would address the problem.
