I coown a house with my boy friend but my name is not in the mortgage ?

Caryn
Do I need to sign the papers to refinance the house?

An
Co-own would mean your name is on the deed... If it isn't, then you have rights to nothing.

Addie
If my name was not on the deed I would not sign anything, why do you pay money if you are not on the deed? He's gonna hose you later!

Devon
No, if the refinance is in his name only, you will not have to sign the closing paperwork. Only if your name goes on the refi loan. You ARE joint owner with survivorship benefits as long as your name is on the deed. Just because you are on the deed does not mean you have to be on the financing.Mary in Camden, MI

What matters is if your name is on the deed. If you are on the deed, you are a co-owner for sure. Any future mortgages will require your consent, including a refinance. Before you sign the refinance papers, ask your boyfriend to have an attorney draft an agreement between the two of you that identifies the specific arrangement you have with regard to who owns how much of the existing equity in the home, and who is responsible for what expenses etc.

Jalisa
I would think that if your name is on the deed, then the mortgage company would require your name to be on the mortgage papers too. If the mortgage company is not requiring you to sign the mortgage papers, then you need to make sure your name is actually on the deed. That is the only way you co-own anything. Talk to your real estate closing attorney.

Clarita
If your name is not in the mortgage, you don't co-own anything.

Alethea
So your his room-mate. How sad.

Lasonya
If you're name is not on the mortgage then you don't "co-own" anything. If you were married you could at least get 1/2 of the home as part of a community property settlement but w/o marriage you can't. Get your name added if you are contributing financially to this mortgage.

Lynwood
ok you have your name on the deed to the house but not the mortgage so no you don't have to sign anything

Dalila
Dear you dont co own anything! He owns the house free and clear. All you are doing is helping him pay for his! house. either get your name on the title or get out!! You will surely pay in the end. You are dating. what is keeping him from moving on to another woman and dumping you? without a cent to your name and lost earnings, in a home you dont have any stake in besides your hard earned cash? Make the change today or find a home of your own and pay for that!!

Hannelore
hun, if your name its not on it then you dont own anything..did he thank you for the money?

Dorothy
If your name is not on it you don't co own it. If your are also buying it with him I strongly suggest you get your name on all the paper work and dead.

Brittany
if you want it in your name, yes you cosign when you re-finance. i'm currently doing this with my fiance to get my name on the house.

Greta
Is your name on the deed?

Genevieve
Im bet im the 100th person to answser your question by saying : IF your name is not on the mortgage YOU OWN NOTHING!! YOU are Not a co-owner.What does he want you to sign? It sounds to me like you need to be VERY cautios here...this guy is doing something dirty asking you to sign a refinance paper

Magan
lisa D wrong ! when you both bought the home you needed to make sure the deed had both your names.-but in your case you might not want the house in your name? if you pay equal amount to the mortgage you need to be on the deed. either way you would be like paying your bf for rent. and you have no legal content.

Domonique
You don't Co~Own a house if your name is not on the deed. So why would you sign the papers to refinance? You are looking for problems with this one, Good Luck!

Goldie
If you and your boyfriend are not jointly named on the deed to the property which includes the house, then you co-own nothing. Just helping him pay the bills. Nothing is legal, and you have no legal right to anything.
