BarbWhat are the legal procedures of doing taxes when it come to property that isn't in your name or social, like mortgages. Can you still claim it or would that be fraudulent? I've been divorced from my husband for over a year and he hasn't made any motives to refinance the house in his name, therefore he shouldn't be able to claim it on his taxes even though he has been still living there.
Cheryif the house is in your name only, you have the rights. If it is jointly held, it may go to whos paid the interst and property taxes...if it is yours to claim, just do it as the burden of proof will be his if the IRS catches it.

Did you get the statement or did he - and who's name(s) appeared on the statement?If he's living in the house, that one part of deducting interest payment from taxes, the other is who made the payments.Talk with a tax consultant in your state.
