Husband trying to take equityrefinancing our house without me?
HwaI am in the state of FloridaMy husband is planning on leaving me, (other women) We got married in 2002. I had a property at that time in just my name. He went to jail, I sold my property to get him a good lawyer because I know we had the other house. The 2nd house "The marital property" was bought in just his name, even though it was bought after our marriage, my name is not on the deed or the loan. Now he is planning on taking out all of the equity and leave me to pay the bills. Is there anything I can do to stop him from taking out the equity, refinancing or from selling the house without me. According to Fl law I have interest in the property. We have a newborn and he has a son. I was thinking of filing a lien but I am not sure how to do that or if there was another way. Please help!!! I am desperate

AdahYou need to talk to a good lawyer. Dont back down on this matter. You need to stick to this and not be left holding the bag. What a jerk since you helped him out wehn he was in jail and now he wants to leave you with all this debt. Dont let him bully you into being the sucker.

LucilleI am almost positive that FL is a "Spousal State" and therefore, he cannot do anything (i.e. refi, sell, or take a HELCO) without you signing something. What did you sign when you bought the home? I work for a mortgage co. in CA and I can pull your title and vesting for you if you want me to look up the property. Reply to this and I will give you my office e-mail so I can pull you title and vesting.

FrediaAnt is correct. Florida is simliar to CA were he works.Both are community property states. However Fl is you can not sign an interspousal deed to convey your marital interest. The spouse must sign the security instrument regarless if they are on title.If you were planning on living in the proeprty when you bought it, you should have signed the mortgage the first time.
