How can i not be screwed in his bankruptcy?

Logan
My ex husband filed bankruptcy before I could refinance my truck and before he refinanced the house. Now my account (truck) is showing his bankruptcy and my credit is showing it for the house. What can I do? I cant afford a lawyer and I'm really confused. He listed me as a creditor (because of the truck) but it isnt affecting my payments, just ruining the account and my credit! HELP!

Unfortunately, this is what happens when someone co-signs for someone else. Anything that happens on that account affects both borrowers credit. It's probably not fair but it is real.If you have not filed bankruptcy yourself, contact your creditor (whoever has the truck financed) and let them know that you have not personally filed bankruptcy and are willing to assume full responsibility for the debt. I can almost guarantee that they will be more than happy to work with you since they are going to receive "nothing" in the bankruptcy (other than the truck back which they don't want). Once you have it in your own name, you are no longer affected by the bankruptcy of your co-signer (I hate to be legalistic but your husband is the identical thing as a co-borrower on the loan). All of this is contingent on the assumption that the loan is current and that you can afford the payments. Hope this helps!!!

You say you can't afford a lawyer, but I think that you can't not afford one. You will have to get a lawyer at some point, because of the legal side of the matter.
