How can i get a court to force my sister to refinance a house in her name?

I signed a quit claim deed to give my sister my house but did not know that the mortgage was still in my name. Is there a way to take her to court to try to have a judge force her to refinance. Without paying an attorney to do it. I live in Texas. Thanks.

You can't. A quit claim never effects a mortgage.You may find yourself sued though, with the bank calling the note due. I am sure you violated your mortgage agreement.

Actually you both have a problem. If the lender enforces the due on sale clause and commences foreclosure, your sister will be out a house and you will have a big ding on your credit. If your sister learns she may be out of a home, she might become cooperative.realtor.sailor

no but the due on sale clause by the lender may be executed and a foreclosure even if current can start
