Ex 10k behind property tax and made few house payments?

My husbands ex wife lives in their other marital home. He got one, and she got the other in the divorce. They did a quit claim deed for each property they live in. He is still on the mortgage where she lives, she hasn't refinanced and he CAN'T now because she has missed 8 out of the last 11 payments. She is also 10k behind in property tax. Went to court, judge said it hasn't "been long enough, give her a chance" after she claimed how much she wants to keep the house. WE think she is planning on ditching the place when their daughter graduates this June, leaving it up for foreclosure (I'm shocked they haven't foreclosed already!)... Is there ANY legitimate ideas? His credit is ruined, we can't even refinance our house we live in, and she is absolutely an insane woman who is delusional and tells him she is paying all her bills when he asks. I truly think she is mental, let it go? back to court? Any special kind of lawyers that can handle this? Serious answers only please, we really need help. Thanks!

You can take it back to court, but you have to open the previous case. You can not sue her twice over the same issue. You need to reopen this one and go back to the same judge. Expect the judge to award her all legal fees (your husband will have to pay her attorney) since she already had a hearing, complete with judgment on this. He is not likely to force a refinance as he is not stupid and he will know she can not follow an order like that.

Like many fools your husband OWES on a property he has no legal ownership in. IF he is stupid enough to have the same arrangement in HIS house then she is still on that mortgage, if she ever was to begin with, and has no ownership rights in.Too bad they did not seek legal counsel in this mess or they would have each refied their separate properties and been done with each other.Oh and be advised that what the Judge may have ordered in a divorce has absolutely NO BEARING in the mortgage company coming after your hubby for the payments and ruining his credit as well.You need to see an Atty and see what can be done but right now it looks like you have very few, if any, choices.
