Does cosigner have to be present to refinance the house?
AudieMy parents are legally married, but have been separated for about a year. My father would like to refinance our house and get money out for some repairs that need to be done. My parents are not on good terms with each other and my father would like to do this without her because he knows that she will not cooperate orshe will want money in return, that he will have to pay back to the bank.

GeorgeannTo refinance, only those who will be liable for the new loan must sign. As long as the old lender gets paid, they don't need any signatures. The title does not matter. No changes are made to the title. Report Abuse

DiedreIf they are both on title and own the home, yes they both need to be present to sign the paperwork. If your father is on title by himself, but they are both on the existing loan that is being paid off and only your father is on the new loan, your mother does not need to be present when signing the paperwork unless she is currently living there and you live in a homestead state.
BarrettIf your mother is currectly on title then she would have to sign a quitclaim deed in front of notary public. If your dad is on title by himself then he should have no probems.
