Can you refinance a house with power of attorney?

My husband has power of attorney over his elderly and terminally ill mother. He is the only child. Her husband passed away long ago. SHe owns a house and property which is worth around $90, 000. It was paid off but she has now two mortgages on the house for around $60, 000. In order to take care of her last wishes and such my husband was hoping to be able to refinance the house for about $5, 000 or so. Is that a possibility? Yes, he can... as a Power of Attorney... he is able to do anything .. that she could of done.. he will have to refinance the two mortgages... if they are attached to the home... just tell him to talk with some one at his bank or mortgage company... they can help him sort thru this... Good Luck!!!

Please seek an estate attorney as the POA may not include refinancing...You would probably be best off in selling the property well ahead of any need to do so as part of an estate. Place all the proceeds in trust for the estate so that the estate can be properly accounted for.Please seek an experienced estate attorney.
