Can you refinance a house if you are in the middle of bankrupcy ?

about 2 years ago my husband had cosighned on a house with his dad. we are now looking for a house, but can not get one because his name is still on that other house. now we were told that my father -in-law can not refinance the house until bakrupcy is over. is this true? (oh and the house was not included in the bankrupcy.)

That is generally true. I assume you are talking about a chapter 13 bankruptcy. Generally the refinance would need to pay off the bankruptcy or the bankruptcy must be discharged. However, if you can show through 12 months of cancelled checks from your father- in- law that he makes the house payments, you should be able to go ahead with your purchase.
