Can i sign our house over to my boyfriend? read more please?

My boyfriend and I purchased a house together a year ago. The house is currently in both of our names. If our relationship falls through is there any way I can "gift" him the house and get my name off all the paperwork or do I have to sell it to him and he has to do all the refinance stuff?? We're trying to make it as easy and pain-free as possible?? (Don't know if it matters, but we live in Texas)

It's called a "quitclaim deed" (not quick claim). And you could sign one deeding your share of the property over to him, he could record it, and that would be that. Your name would still be on the loan though, so if he defaults, your credit will be damaged.To avoid that you could have him refinance the property with a loan he's the only borrower on, and have your quitclaim recorded in conjunction with that refiance.

If you purchased it together and created a loan to acquire it together then you will both have to agree to sell the property, since you are both going to be held responsible for the loan. If you merely convey the property interest you have to him you will still be held responsible under the loan and such a conveyance might be addressed in the mortgage instrument as one of the events which could trigger an acceleration of the loan since the lender might feel that their security is jeopardized. Well fishtoes(ugly name. i mean who wouldnt dump you if you had this name) if you think you and the guy will break up then dont be stupid and buy the house idiot. just buy a nice box, the ones the homeless use in L.A those big 62" inch plasmas are good boxes hun. First you can either sell the House to him, or you can refinance the house in his name only. Check with your mortgage company to find out what can be done. Also contact a Lawyer and get his advice in this. You have to realize that you signed a contract with both of your names and income to establish the loan.

Just have to sign a quick claim deed. and that should get you name off the deed.

If you are both on the LOAN then yes, he will have to refinance the loan to get you off of it along with the quit claim deed. If you are not on the loan and only went on TITLE, then you can quit claim and it will be over.This is of course assuming you don't want any equity and/or downpayment money you invested in the house and just want to walk away from it.
