No, you absolutely cannot have your house on the market during the refinance. You can list it the day it records. You may want to be sure you will NOT have a prepayment penalty on this loan before doing it or you may have just increaased your selling costs by about six percent. I wouldn't suggest doing an expensive refinance if you are wanting to sell immediately.

It isn't worth it to refinance if you are just going to sell it. It would be a waste of money unless you think it will take a really long time to sell your house. I wouldn't refinance a home unless I planned on staying there for three years or more to recoup the closing costs and interest.

Wait until you refinance, if it show up that it was on the market, most banks will not approve it or limit the loan amount.

There is no legal reason you couldn't list while refinancing. Nor can I think of a reason why you would want to.Why would you take out a brand new loan and pay all those closing costs when you're going to be paying it off in a matter of months if not weeks??
