Can a wife of a married couple refinance a house just under her name and have her husband be free and clear?
DungYes as long as she has the credit scores necessary to get the loan and the income to qualify for the loan independant of her husband. Your problem will be in holding title to your current home you plan on refinancing. He would have to sign completely off the title leaving the home in your name only. If you qualify for the refi, he can be added back on title but would have NO responsibility for the loan repayment. Nor any owership to the property since he signed off on that prior to the refi. Good luck convincing him to put himself in that losing position..
CalvinIt depends on whos' name is on the house! If her name is on the house then YES! If the house is under his No! If the house is under both the husband can give her full ownership and then she is capable. It is just like filing for a loan, when married you can file joint or seperately. It is always safer to file seperately so that if ones credit goes bad you have the others to fall back on! Another you can do is if in his name alone he can sign the home over to you, giving you ownership, which takes 60-90days and then refinance the home.
