Can a judge stop child support and order a person to pay the house payment instead ?

I was divorced in 2006, and my ex wife was given the house that she and my 2 sons live in. I was ordered to pay child support until my sons are 18 years of age, which is 5 years for the youngest one. my ex wife is having trouble making the mortgage payment and is now over 30 days behind. we have been to court over 6 times and have a date coming up real soon. the judge has already stated to her she needs to make timely payments on the house, refinance the house in her name only or sell the house. She has stated that she uses the child support to make the house payment while we were in court.I was thinking that if the judge remove the child support then i will refinance the house in my name, make the payments on the house and my ex wife and sons can live there until the youngest is 18 years old, after that I will sell the house to my ex wife for the value of the loan. can i do that ? What do you think ?

No judge will allow it. Sorry!Besides, you never want your children to think you didn't pay child support even if you paid the mortgage instead.

By asking the judge for such an agreement you are basically asking the wrong person. No judge is going to arbitrarily allow an agreement to stop child support like that. The agreement needs to be made between you and your ex-wife. If you and your ex-wife can come to such an agreement you can present it to the judge as a stipulation agreement. If the judge approves, then the new stipulation agreement will supersede all other agreements.

I think you are a lame father. Even if you and your wife are divorced, it is your responsibility to provide your children necessities and shelter. I am sure the two of you knew that mortgage would be a struggle. The house should have been sold and a more affordable alternative should have been found. The tragedy is your children suffer the most behind their parental irresponsibility's. People should think a little more about issues beyond themselves.

It's a ridiculous idea. If she can't afford the house while she is receiving child support, how is she supposed to qualify for a loan when she isn't getting the child support. And the judge is not going to order child support to cease. If this is the arrangement you two want, then you will need to make this arrangement through private attorneys. And why do you keep going back to court?

The situation with the house was adjudicated with your divorce. No judge is going to go back and revisit that issue. Your wife should have been using the child support to make the house payments but she didn't...Why not?
